1. Agreement to Terms

By accessing or using myconvivium.com (the “Site”), you confirm that you have read, understood, and agree to be bound by these Terms and all applicable laws. If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Changes to Terms

We may update these Terms from time to time. The “Effective Date” above indicates when the Terms were last updated. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

Reservations may be offered through third-party booking platforms (for example, OpenTable). Reservation availability is not guaranteed until confirmed. Any cancellation, no-show, deposit, or prepayment terms displayed at the time of booking (and/or in your confirmation message) will apply to that reservation.

Tip: If your reservation is made via a third-party platform, your booking may also be subject to that provider’s additional terms and policies.

6. Pricing, Taxes & Payments

Menu items, ingredients, and availability may change without notice due to seasonality, supplier constraints, or operational considerations. While we can accommodate many dietary preferences, we cannot guarantee an allergen-free environment. Please inform our team of allergies and dietary restrictions before ordering.

8. Private Dining & Events

For private dining or event inquiries, additional terms may apply, including minimum spends, deposits, cancellation windows, service charges, and operational requirements. Where applicable, these terms will be provided in writing as part of your booking agreement.

9. Intellectual Property

The Site and its content (including text, graphics, logos, photographs, videos, and design) are owned by or licensed to Convivium and are protected by Canadian and international intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from the Site content without our prior written consent, except as permitted by law.

The Site may include links to third-party websites and services (including reservation providers and social platforms). We do not control third-party sites and are not responsible for their content, availability, security, or policies. Your use of third-party services is at your own risk and subject to their terms.

11. Disclaimers

The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by law, Convivium and its owners, directors, officers, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or business opportunities, arising out of or related to your use of (or inability to use) the Site.

You agree to defend, indemnify, and hold harmless Convivium and its representatives from and against claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your misuse of the Site.

14. Governing Law & Venue

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law rules. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the courts located in Toronto, Ontario, and you consent to the personal jurisdiction of such courts.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
